Terms of Service

Welcome to ApertureOps. By creating an account and using this platform, you agree to the following terms. Please read them carefully.

1. Acceptance of Terms

By registering for an ApertureOps account, you confirm that you are at least 18 years old, have read and understood these Terms, and agree to be bound by them. If you do not agree, do not create an account.

2. Description of Service

ApertureOps is a photography and video business management platform providing tools for project tracking, client management, invoicing, file delivery, booking, contracts, and AI-assisted content generation. Features may be added, changed, or removed at any time with reasonable notice to subscribers.

3. Your Account

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. You agree to notify ApertureOps immediately of any unauthorized use of your account at hello@apertureops.app. ApertureOps is not liable for any loss resulting from unauthorized account access.

4. Data Storage & Privacy

ApertureOps stores your business data (projects, clients, invoices, settings, and related records) in a secure cloud database hosted on AWS infrastructure. Data is encrypted in transit (TLS) and at rest, and access is restricted to your account via row-level security policies. Your media files are stored in ApertureOps Cloud. A local browser cache is maintained for performance and is cleared on sign-out.

AI features are provided through a secure server-side proxy. Prompts you submit are forwarded to Anthropic's API and are subject to Anthropic's privacy policy. ApertureOps does not retain prompt content beyond the duration of the API request.

You are solely responsible for maintaining appropriate backups. You may download a full backup at any time via Settings → Download Backup. See our Privacy Policy for full details on how we handle your data.

5. Acceptable Use

You agree not to use ApertureOps to: (a) violate any applicable law or regulation; (b) infringe on any third party's intellectual property or privacy rights; (c) transmit harmful, offensive, or fraudulent content; (d) attempt to reverse-engineer, copy, or resell the platform without written permission; or (e) use the platform for any purpose other than legitimate photography/videography business management.

6. Client Data Responsibility

You are solely responsible for any data you enter about your clients, including names, email addresses, and financial information. You agree to handle all client data in accordance with applicable privacy laws (including GDPR, CCPA, or similar regulations in your jurisdiction). ApertureOps provides the tools, legal compliance is your responsibility.

7. Subscription & Billing

Platform subscription: ApertureOps Pro is billed at $29.99/month. New accounts receive a 14-day free trial. A valid payment method is required at signup; no charge is made until the trial ends. Subscriptions renew automatically each month until cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period with no partial refunds.

Client invoicing: ApertureOps provides tools to create invoices and connect your own payment processor (e.g., Stripe). Transactions between you and your clients are solely your responsibility. ApertureOps is not a party to those transactions and makes no guarantees regarding payment collection.

8. Intellectual Property

ApertureOps and its underlying code, design, and branding are the intellectual property of ApertureOps and its creators. You retain full ownership of all content you create using the platform (projects, invoices, contracts, client records, etc.). You grant ApertureOps no rights to your business data.

9. Service Availability & Disclaimer

ApertureOps is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted service, error-free operation, or that the platform will meet every requirement. We will make reasonable efforts to maintain uptime and notify users of planned maintenance. Always maintain your own backups.

10. Limitation of Liability

To the fullest extent permitted by law, ApertureOps and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of data, loss of revenue, or business interruption. Our total liability to you shall not exceed the amount you paid to ApertureOps in the three months preceding the claim.

11. Termination

ApertureOps reserves the right to suspend or terminate any account that violates these Terms, with or without notice. Upon termination, your right to access the platform ceases immediately. You may delete your account and export your data at any time via Settings.

12. Changes to Terms

ApertureOps may update these Terms at any time. We will notify active subscribers of material changes by email at least 14 days before they take effect. Continued use of the platform after that date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
